Module 03: Amazon Brand Registry trademark requirements, in order
Amazon Brand Registry's trademark requirements are short: your brand needs "an active registered trademark or a pending trademark registration" from an approved government IP office, and your brand name must be permanently on the product or its packaging (Sell on Amazon, Brand Registry requirements). Brand Registry itself is free.
The hard part is time. The trademark has the longest clock in any launch, so file it first. A pending application is enough to enroll, which means the filing date, not the registration date, decides when you get A+ Content, Sponsored Brands and the brand protection tools.
Most new stores take months to find steady sales, and some never do. Inventory, platform fees, freight and ad spend are paid by you.
What are the Amazon Brand Registry trademark requirements?
Four things, all from Amazon's own pages:
| Requirement | What Amazon says | Source |
|---|---|---|
| A trademark | "An active registered trademark or a pending trademark registration" from approved government IP offices | Brand Registry requirements |
| The right kind of mark | A text-only word mark, or "an image-based mark with words, letters, or numbers (design mark)" | Brand Registry requirements |
| Brand on the product | A logo that includes your brand name, "permanently affixed to your products or packaging" | Brand Registry |
| An Amazon login | A Brand Registry account using the same login as your Seller Central account | Brand Registry requirements |
A design mark that is only a picture, with no words, letters or numbers, does not qualify. And the brand name you enter must match the trademark record exactly.
Is a pending trademark enough?
Yes, for Amazon. Brand Registry accepts a pending application from an approved office, so you can enroll with the serial number as soon as you have filed (Sell on Amazon, Brand Registry requirements).
That is not true everywhere. Walmart's Brand Portal needs a trademark fully registered with the USPTO; it says a pending application with an eight-digit serial number "may be pending and not yet eligible" (Walmart Marketplace Learn, Brand Portal overview). If Walmart is in your plan, the registration date matters too. Walmart module 08 covers what carries over.
How long does a US trademark take, and what does it cost?
The USPTO reports a first action in an average of 4.45 months in the first half of fiscal 2026, and total processing time of 10.03 months (USPTO, May 5, 2026). The base application fee is $350 per class, and surcharges apply in some cases (USPTO fee schedule). Attorney fees come on top.
Here is how those clocks line up with a typical first product. Illustrative · sample figures, not a forecast:
| Week | Trademark | Product |
|---|---|---|
| 0 | Name searched and application filed; serial number received | Supplier samples ordered |
| 1 to 2 | Brand Registry application submitted with the serial number | Packaging artwork with the brand name approved |
| 2 to 4 | Brand Registry approved (if the correspondent confirms in time) | Production starts |
| 6 to 10 | Application waiting for examination | Stock arrives; A+ Content and Vine ready at launch |
| About 19 | First USPTO action on average | Selling, with brand tools already on |
File in week 0 and the trademark is never the reason a launch waits.
What is IP Accelerator?
IP Accelerator is Amazon's program that connects brands with Amazon-vetted IP law firms for trademark filing. Amazon does not charge to connect you. The law firm's fee for a US trademark application (one brand, one class) is capped at $700, plus government fees such as the USPTO's $350 base fee per class (Sell on Amazon, IP Accelerator; USPTO fee schedule). Brands that file this way get faster access to Brand Registry benefits while the application is pending (Sell on Amazon, Brand Registry requirements).
| Route | Good fit when | Watch for |
|---|---|---|
| IP Accelerator firm | You want a known cost ceiling and faster Brand Registry access | Fee covers the filing; office actions or oppositions can cost more |
| Your own trademark attorney | You need advice across several classes, countries or a crowded name | Get a written fee quote first |
| Filing yourself | Simple word mark, clear search, one class | Mistakes in the goods description or class are costly to fix later |
This is not legal advice. Ask a trademark attorney about your name and classes.
What does Brand Registry give you?
Amazon lists A+ Content, Brand Analytics, Sponsored Brands, Brand Stores, Amazon Vine, Transparency, Project Zero, Report a Violation and Manage Your Experiments (Sell on Amazon, Brand Registry). In plain terms: richer product pages, search data on what shoppers type, brand ads, a storefront, early reviews through Vine, anti-counterfeit tools and the right to report listings that misuse your brand.
Two 2026 details add to that:
- New Seller Incentives.
New-to-Amazon sellers on the Professional plan who enroll a brand within six months of their first eligible listing can get 10% back on the first $50,000 in branded sales, then 5% on the next $950,000, plus a $200 Vine credit if they enroll a product in Vine within 90 days. Both have conditions and expiry dates (Sell on Amazon, New Seller Incentives).
- No stickers for brand owners.
For inventory shipped on or after Mar 31, 2026, sellers with the Brand Representative role no longer need Amazon barcode stickers on products with a manufacturer barcode, while resellers must sticker (Amazon Seller Forums, commingling ends). That saves a label on every unit.
How to enroll in Brand Registry, step by step
Amazon's enrollment has five steps (Sell on Amazon, Brand Registry requirements). Gather the inputs first: brand name exactly as on the trademark record, logo image, the trademark serial or registration number, product categories, a photo of the product or packaging showing the brand name, and your website or distribution details if you have them.
- 01Create a Brand Registry account
with the same login you use for Seller Central.
- 02Provide brand details
on the "Enroll your brand" page: trademark information, brand name, logo and categories.
- 03Submit product photos
that show the brand name permanently on the product or packaging. A sticker added for the photo will not pass.
- 04Verify your identity.
Amazon may ask about manufacturing or distribution.
- 05Review and submit.
After you submit, Amazon may email the trademark correspondent or public contact on the trademark record. That person must confirm the brand link within 7 days or the application is declined. If an attorney filed for you, tell them to expect the email.
The order that works
Six steps, with the slowest first:
- Search the name in the USPTO database and on Amazon before you print anything.
- File the trademark in the classes you sell in, with an attorney or through IP Accelerator.
- Put the brand name or logo on the product or packaging.
- Register your seller account (module 04).
- Apply to Brand Registry with the serial number of the pending application.
- Turn on A+ Content, Vine and Brand Analytics as soon as you are approved, and use them in your listings (module 05).
Common mistakes
-
Printing packaging before the name search.
A conflict found later means new artwork and new stock.
-
A logo-only design mark.
It needs words, letters or numbers to qualify.
-
Brand name mismatch.
"Acme Home" on the box and "ACME" on the trademark record slows or stops the application.
-
Nobody watching the correspondent's inbox.
The 7-day confirmation window passes and the application is declined.
-
Listing first and enrolling later.
The New Seller Incentives windows start with your first eligible listing.
Key takeaways
- A pending trademark from an approved office is enough for Amazon Brand Registry.
- File first; the USPTO's first action averaged 4.45 months in early fiscal 2026.
- IP Accelerator caps the law firm's filing fee at $700 plus government fees.
- Walmart's Brand Portal needs a registered mark, not a pending one.
Do this now
- Search your brand name in the USPTO database and on Amazon.
- Choose your classes and file, with an attorney or through IP Accelerator.
- Add the brand name or logo to packaging artwork.
- Save the serial number and tell the trademark correspondent to expect Amazon's email.
- Gather the enrollment inputs listed above.
Watch and practice
- Short: "Should you file your trademark before you launch?" (29 seconds). Characters are fictional. Voices are AI-generated.
- Tools: Amazon Brand Registry and IP Accelerator (Sell on Amazon, Brand Registry). Back to the Amazon guide.
Problem and fix
"We launched without a trademark, and now we cannot protect our listings." Cause: no Brand Registry, so no Report a Violation, no content priority and no brand tools. Fix: file now and enroll with the pending mark. Service: Store Launch for Amazon ($1,499) includes Brand Registry application support; we refer trademark filing to an attorney or IP Accelerator. Measure: Brand Registry approved before the first FBA shipment lands.

Can I join Brand Registry with a pending trademark?
Yes. Amazon accepts a pending application from an approved government IP office (Sell on Amazon, Brand Registry requirements). Enroll with the serial number as soon as you file. Walmart's Brand Portal is different: it needs a fully registered USPTO trademark.
How much does Brand Registry cost?
Nothing. Amazon describes it as a free program (Sell on Amazon, Brand Registry). The trademark is what costs money: the USPTO base application fee is $350 per class (USPTO fee schedule), plus any surcharges and attorney fees, or up to $700 for an IP Accelerator firm's filing.
How long does a US trademark take?
The USPTO averaged 4.45 months to a first action and 10.03 months of total processing time in the first half of fiscal 2026 (USPTO, May 5, 2026). Office actions or oppositions add time. Because Amazon accepts pending marks, the filing date is what matters for Brand Registry.
Do I need Brand Registry to sell on Amazon?
No. You can sell without it. But you lose A+ Content, Sponsored Brands, Brand Analytics, Vine, brand protection tools and, for eligible new sellers, the branded-sales bonus (Sell on Amazon, Brand Registry; Sell on Amazon, New Seller Incentives). For a private label brand, that is most of what makes the listing defensible.
Does my logo have to be on the product?
Yes. Amazon asks for a logo that includes your brand name, permanently affixed to your products or packaging, and asks for photos showing it (Sell on Amazon, Brand Registry). Printed packaging or an engraved or sewn-in label works; a removable sticker does not.
Why was my Brand Registry application declined?
The common reasons are a brand name that does not match the trademark record exactly, product photos without the brand permanently shown, a design mark with no words or letters, or the trademark correspondent not confirming Amazon's email within 7 days. Fix the cause and reapply.
Does Ecom Relays file trademarks?
No. We are not a law firm. We refer you to a trademark attorney or Amazon's IP Accelerator and handle the Brand Registry application once the mark is filed.
